Food Standards Australia New Zealand (FSANZ) opens the 2nd proposal to review caffeine content in foods

FSANZ has prepared a revised proposal to review permitted caffeine levels in sports foods and in the general food supply.
This comes in light of the first round of comments received in December 2022 when the proposal was published for comments. Some of the proposals in the new draft include: 
  • prohibiting the retail sale of caffeine as a food unless expressly permitted
  • prohibiting the retail sale of foods containing caffeine as an ingredient or component unless expressly permitted
  • repealing the current prohibition on foods for retail sale containing caffeine in a concentration of 5% or more if that food is a solid or semi-solid food; or 1% or more of the food for sale if that food is a liquid
  • expressly permitting formulated supplementary sports foods (FSSF) to contain caffeine up to 200 mg in a one-day quantity and setting new compositional, packaging and labelling requirements for FSSF, including a requirement that a FSSF must not contain caffeine at a concentration of 5% or more for a FSSF in a powdered form; or 1% or more for a FSSF in a liquid form.
